For a period of 3 (three) years from the Start Date, the rent payable to the Lessor shall be no less than 8.33% (eight 33/100 percent) of the net purchase price (price without VAT) of the premises, paid under the terms specified in the preliminary agreement.
The Start Date is the date designated by the Operator, falling within a period no later than 31 (thirty-one) days from the date of premises acceptance (Acceptance occurs after payment of the price due to the Developer).
Payment of the minimum rent takes place after the end of each year of cooperation, in the event that the sum of the standard (proportional) rents due during the year does not reach the assumed minimum value. The minimum rent is supplementary and constitutes an additional payment to the basic rent.
The minimum rent does not include mandatory costs borne by the owner of the premises in connection with ownership rights of the premises (property tax, renovation fund, and maintenance of common property) and under the lease agreement (conservation fund, marketing fee, premises insurance). The income obtained is also subject to taxation in accordance with legal regulations. The Operator is responsible for paying the rent (both minimum and proportional).
The terms of the promotional offer are defined by the Agreement between the Parties to the lease agreement, concluded by the Operator with the client along with the lease agreement.

**Disclaimer regarding the projected rate of return from the minimum rent
Calculations concerning the projected annual rate of return are solely promotional and illustrative and do not constitute an offer within the meaning of Article 66 of the Civil Code.
The amount of rent due to buyers of premises will be determined each time based on the net price of the premises reduced by VAT (net price of the premises). The annual rent will be 8.33% of the net price of the premises specified in the preliminary agreement. The annual rate of return will differ for consumers and clients purchasing premises for purposes related to business activities, who have the right to deduct VAT (showing input VAT).

For consumers, the annual rate of return will be 6.77%.
Example: The net price of the premises is PLN 1,000,000, the gross price (increased by VAT) is PLN 1,230,000. The basis for rent determination is the net amount, thus the annual rent will be PLN 83,300 (quarterly rent PLN 20,825).
In the case of an investment made by a consumer who does not have the right to deduct VAT, the annual rate of return will be 6.77% (PLN 83,300 / investment amount of PLN 1,230,000).

For an entrepreneur, the annual rate of return will be 8.33%.
Example: The net price of the premises is PLN 1,000,000, the gross price (increased by VAT) is PLN 1,230,000. The basis for rent determination and settlement is the net amount, thus the annual rent will be PLN 83,300 net (quarterly rent PLN 20,825).
In the case of an investment made by an entrepreneur entitled to deduct VAT, the annual rate of return will be 8.33% (PLN 70,000 / investment amount of PLN 1,000,000).

The above calculations do not include mandatory costs incurred in connection with acquiring ownership rights of the premises:
1) costs of acquiring the premises (notarial and land and mortgage register fees related to concluding the preliminary and final agreements, possible costs of debt financing),
2) costs related to ownership rights of the premises and ownership share in the common property (property tax),
3) costs incurred under the lease agreement (conservation fund, marketing fee, premises insurance, possible repairs charged to the lessor).
The income obtained is also subject to taxation under applicable law. These charges will reduce the achieved annual rate of return.
